House lawmakers in Kentucky have given preliminary approval to a bill that would legalize medical cannabis in the state.

If passed, the legislation would allow doctors to prescribe medical cannabis to patients for six qualifying conditions: cancer, chronic pain, epilepsy/seizure disorder, multiple sclerosis, chronic nausea or cyclical vomiting syndrome, and post-traumatic stress disorder (PTSD).

The proposal would prohibit smoking as a form of use, and home cultivation would not be allowed.

If the bill passes final approval, Kentucky would become the 38th state to legalize medical cannabis.

The Pros and Cons of Legalizing Medical Cannabis in Kentucky

The New Jersey Cannabis Regulatory Commission has delayed the adult-use market again, citing a lack of supply from current medical operators as one reason for the postponement.

According to one multi-state operator, that shouldn’t be the case. In an exclusive statement provided to Grown In by the NJ CRC, the commission says it wants to make sure the MSO’s operating in the state have the ability to provide to both the current medical patients they assist, as well as the incoming adult-use market.

The NJ CRC is committed to ensuring physical integrity and product safety for all cannabis products entering the New Jersey market. They are also working diligently with stakeholders to ensure a smooth transition to adult-use legalization.

The Impact of the Delay on the New Jersey Economy

Off-duty police officers in New Jersey are now allowed to consume cannabis products, according to a new memo from acting state Attorney General Matthew Platkin. This means that police officers will not face any discipline for consuming weed, as long as they are 21 or older.

This change comes just before recreational weed sales are set to begin in a handful of retail locations on April 21. The law was passed after voters in New Jersey approved a constitutional amendment in November 2020, which legalized the regulated sale of cannabis products to people 21 and older.

So if you're a police officer in New Jersey, feel free to enjoy some weed — just like anyone else!

In our New Jersey cannabis license video, we're going to go over a flowchart that I've created after review of the regulations, the regulations, this is the flowchart, the regulations themselves are 160 pages, and they came out on August 19. So a month ago, New Jersey hasn't released in additional details, they'll probably be coming out. But you have to be conscientious of the litigation that's continuing to go on with previous applicants from 2019. They're trying to be resolved and taken care of prior to more being developed. But that's, that's something that you kind of have to plan on in New Jersey, especially with the method that I'm going to be going over and disclosing for you. This is one of the things that I would do if I'm going to be approaching an application in New Jersey, or how I'd approach it for my clients, because it's going to require a little bit of math, but then also some
understanding and appreciation about how the regulations are coming together. And methods that you can use to comply with the spirit of the social equity and the priority applicants that are granted priority in their application process and the lower barrier to entry that this method will create. Now, this is an easy method, we are going to discuss something called spvs. 

They stand for special purpose vehicles. These are complex, they are extremely complex, very often they're called hedge funds or private equity funds. But you're on the east coast. So people know about them. They're limited partners. If anywhere, they're going to have it, it's going to be in New Jersey. And the reason why I say that is because I read these regulations. And there were two things that stood out. One was the concept called passive investor in New Jersey, are you a passive investor. Another concept was the financial sources agreement. If you have a financial sources agreement, another concept was the management agreement. And then the restrictions and the number game on those. For example, if you are talking about a financial sources agreement, you can have seven, if you're talking about a management management agreement, you can have five, you're talking about passive investment, you comprise 5% or less of the ownership in the license holder, and you have no say in the matter.

Biden Can Legalize Marijuana According to Congressional Research Service

I’ve just been handed an urgent news bulletin

President Biden has the authority to reclassify cannabis according to a report from the congressional research service published on November 2nd.  

Wait is that right?

Okay, well, I’m Tom you can find me at CIL on the interwebs and let's go over this report they published. 

Oh right, please like and subscribe for more of us in your feed, if you’re trying to break into the industry as a license holder - we’re one of the best channels you can find. 

First, we draw your attention to the Congressional Research Services (the CRS) admission that the president cannot commit the legislative act of removing the word marijuana from the Controlled Substances Act (the CSA). However, because of the way the CSA is written it may be a distinction without a difference when it comes to legalizing it. 

You see, the CSA can be changed by Congress or by administrative rulemaking. This is overseen by the Drug Enforcement Agency (The dreaded DEA) - but it has denied numerous petitions from people to reschedule cannabis. The DEA just like Congress has the power to change the scheduling of marijuana, or to deschedule it and remove it from the CSA entirely. 

The CSA empowers DEA to make scheduling decisions through the notice-and-comment rulemaking process, in consultation with the Department of Health and Human Services (HHS) (HHS has delegated its fact finding role in this process to the Food and Drug Administration (FDA)). 

So how does he do it?  Executive Order like Former President Donald J. Showoff his signature.

Biden could appoint heads of DEA, HHS and FDA that support descheduling.  Has he done this?

FDA - considering Robert Califf - as of October 22 2021 - no comment 
HHS - Xavier Becerra - confirmed March 18 2021 - Enforced California’s marijuana laws as AG before running HHS. 
DEA - Former AG of NJ Anne Milgram - Not really sure. 

Let’s see if we can get any position from them on this matter so that we can move forward and legalize it so that the half of the states operating outside of the law the federal government is not enforcing can not be penalized because they have a federal law that says it is illegal - but a policy that says they won’t enforce it if you have a license from the state.

President Biden has the authority to reclassify cannabis according to a report from the congressional research service published on November 2nd.

Oh right, please like and subscribe for more of us in your feed, if you’re trying to break into the industry as a license holder - we’re one of the best channels you can find.

First, we draw your attention to the Congressional Research Services (the CRS) admission that the president cannot commit the legislative act of removing the word marijuana from the Controlled Substances Act (the CSA). However, because of the way the CSA is written it may be a distinction without a difference when it comes to legalizing it.

You see, the CSA can be changed by Congress or by administrative rulemaking. This is overseen by the Drug Enforcement Agency (The dreaded DEA) - but it has denied numerous petitions from people to reschedule cannabis. The DEA just like Congress has the power to change the scheduling of marijuana, or to deschedule it and remove it from the CSA entirely.

The CSA empowers DEA to make scheduling decisions through the notice-and-comment rulemaking process, in consultation with the Department of Health and Human Services (HHS) (HHS has delegated its fact finding role in this process to the Food and Drug Administration (FDA)).

So how does he do it? Executive Order like Former President Donald J. Showoff his signature.

Biden could appoint heads of DEA, HHS and FDA that support descheduling. Has he done this?

FDA - considering Robert Califf - as of October 22 2021 - no comment
HHS - Xavier Becerra - confirmed March 18 2021 - Enforced California’s marijuana laws as AG before running HHS.
DEA - Former AG of NJ Anne Milgram - Not really sure.

Let’s see if we can get any position from them on this matter so that we can move forward and legalize it so that the half of the states operating outside of the law the federal government is not enforcing can not be penalized because they have a federal law that says it is illegal - but a policy that says they won’t enforce it if you have a license from the state.

How to Get a Cannabis Business License in Arizona | Arizona Cultivation License and Marijuana Laws

Arizona voted to legalize marijuana when it passed Prop 207 by 60 to 40% of the vote in 2020.  Arizona takes effect once the election results are made official Nov. 30. The Department of Health Services must adopt rules to set the number of licenses coming - but not more than one for every 10 pharmacies operating within the state.  

The Arizona Department of Health Services (“ADHS”) will grant approximately 150 marijuana establishment licenses. Of these licenses, 26 will be specifically allocated to applicants who qualify under the Social Equity Ownership Program.
Define Early Applicant = Entity seeking to operate a marijuana establishment in a county with less than two registered nonprofit medical marijuana dispensaries, or a non-profit medical marijuana dispensary registered and in good standing with the department that wishes to obtain an establishment license. 

Define Social Equity = increasing the license numbers up to 10 % in furtherance of social equity programs created by Department of Health Services. They are going to study it. Section 36-2854 provides for some nebulous concepts. 

Marijuana Establishment = single retail location to sell marijauna products to customers & a signal off-site cultivation location & a single off-site location to manufacture marijuana products. (Mandatory vertical license).

Define license numbers and timeslot = Only two Marijuana Establishment License per county will be issued, as long as it does not contain a non profit medical marijuana dispensary, if it contains one registered non profit medical marijuana dispensary, it will only issue one. The early applications will be accepted from January 19th, 2021 to March 9th, 2021, after issuing the license to the early applicants the department will issue establishment licenses by random selection

Types of licenses available:
The Marijuana establishment license: authorizes to have a single retail location to sell, a single off site location to cultivate, process and produce and a single off site location to manufacture and package marijuana, the last two are not authorized to sell Marijuana in any manufacturing or cultivating location.
The Marijuana testing facilities license: authorizes the analysis and monitoring of the potency of the product and testing for any harmful contaminant in the marijuana.
Delivery after 2023? - ADHS may adopt rules that allow for it.

Bare Minimum Criteria Towards Restorative Justice:
